Heard rival submissions on this application for bail during the pendency of the appeal and suspension of substantive sentence. During the trial the applicants were on bail. The applicants are convicted for the offence under section of 304 Part II read with section 34 of IPC and sentenced to suffer RI for two years and to pay a fine of Rs.10,000/- each, in default SI for six months each. Reportedly, fine amount is paid by the applicants. Today, the appeal preferred by the applicants/appellants against the aforesaid conviction is admitted. Considering the allegations and the conviction for offence punishable under section 304 Part II and considering the imprisonment of two years, in the opinion of this Court, the applicants can be released on bail during the pendency of the appeal. Hence, the order : : ORDER :
The application is allowed and disposed of as under :- The applicants/accused be released on same bail as granted by the trial Court, with fresh bonds to be executed before the trial Court. (A.R.JOSHI, J.) 1/1
