The applicant has preferred the present application for interim bail on the ground that his father namely Abdul Kuddus Kazi was admitted to Lifeline Hospital, Bhiwandi, District Thane and the applicant wanted to arrange funds for his medical treatment. 2.

The learned Counsel for the applicant submitted that the father of the applicant namely Abdul Kuddus Kazi expired in Lifeline Hospital, Bhiwandi, District Thane on 21.8.2016 at about 12.30 p.m. He submitted that now the applicant is seeking interim bail to perform the last rites of his father. The learned APP fairly conceded to the said and submission made by the learned Counsel for the applicant.

In the circumstances, the applicant is entitled to be released on interim bail in C. R. No. II 38 of 2016 registered with Shanti Nagar Police Station, Bhiwandi, District Thane for the period of seven days from the date of his actual release. 4.

Hence, the following order.

ORDER

(a) The applicant be released on interim bail in C. R. No. II 38 of 2016 registered with Shanti Nagar Police Station, Bhiwandi, District Thane on his furnishing P. R. Bond of Rs. 25,000/- with one or more local sureties in the like amount.

(b) The applicant is permitted to furnish cash bail, if the local sureties are not available immediately. (c) After his release from bail. the applicant shall not contact any of the witnesses pertaining to C. R. No. II 38 of 2016 registered with Shanti Nagar Police Station, Bhiwandi. (d) The applicant shall surrender to the jail authority on or before 5.00 p.m. at the end of seven days.
