Heard learned counsel appearing for the Applicant and learned APP appearing for Respondent-State. Perused copy of Roznama produced by learned APP. It appears that, as many as on minimum twelve dates Original Accused No. 1 i.e. present Applicant was absent before the Trial Court. However, learned counsel appearing for the Applicant submits that, in the recent past the Applicant is regularly causing appearance before the Trial Court. She submits that, the Applicant will file an appropriate application for recalling the order of issuance of Non Bailable Warrant by the Trial Court within one week from today. However, she prays that, ad-interim relief granted by this Court may be extended by another three weeks, so as to, enable the Applicant to file an appropriate application before the Trial Bhagyawant

In the light of above, the Applicant is permitted to file an appropriate application for recalling the order of issuance of Non Bailable Warrant before the Additional Chief Metropolitan Magistrate, 69th Court, Mazgaon, Mumbai, within one week from today. In case such application is filed before the Trial Court, the Trial Court to take appropriate decision in accordance with law.

Ad-interim relief granted by this Court and which is in force till date, shall continue to operate/remain in force for three weeks from today. With the above observations, application stands disposed of. [S.S. SHINDE, J.] Bhagyawant
