IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION BAIL APPLICATION NO.1543 OF 2015 Mohammed Firoz Mohammed Jabbar Mandal ..Applicant Vs.

The State of Maharashtra & Anr.

..Respondents ----- Mr. P.R. Dave for Applicant.

Ms. Rutuja Ambekar, APP for the State.

----- CORAM: A.S. GADKARI, J.

DATE : 17th November 2015.

P.C.

The applicant, accused in CR No.53 of 2015 registered with Dahisar Police station for the offence under Section 366, 370, 370(A)(2) read with Section 34 of the Indian Penal Code and Sections 4 and 5 of the Prevention of Immoral Trafficking Act, 1956 is seeking bail. It is the prosecution case that on the specific information given by one NGO namely "Justice And Care" to the police, the Social Services Branch laid a trap. A bogus customer was put into service who contacted the applicant on a given mobile number. The applicant thereafter came with the victim girl at the desired place. The currency notes which were given

2/2 ba.1543-2015 by the bogus customer to the applicant were found on the person of the applicant during the trap. The statement of the victim girl was recorded on 4.2.2015 which depicts very sorry state of affair. It discloses that the poor girls are being lured under the guise of a "lucrative vocation'' who are then put in the trade of prostitution and the persons like applicant earn their livelihood on the same. The victim girl has stated that the applicant was instrumental in pushing her in this trade and the applicant has taken substantial amount for the same. The victim girl has further stated that when she desired to leave the said profession, the applicant lodged her in a room and locked the same. She further stated that the applicant had also put restrictions on her movements and was not allowed to go out. Taking into consideration the serious allegations made against the applicant and the fact that there is every possibility that the applicant will tamper with the evidence if released on bail, I am not inclined to grant bail to the applicant.

The bail application is accordingly dismissed. (A.S. GADKARI,J.)
