On this petition, we had passed an order yesterday.

However, we had a little doubt as to whether we could protect the petitioner's

The whole argument of Mr. Mendadkar was, the Committee refused to abide by the time frame and pass appropriate orders in accordance with law resulting into grave and serious prejudice, in the sense, loss of admission to Engineering and Technical courses to deserving reserved category students.

That is why, we had protected the petitioner's provisional admission but finding that this would seriously hamper and harm the prospects of other meritorious students down the line, but not before us, we placed the matter for today.

We had not signed the order and dictated in open Court on 15.7.2019.

Today, when the matter was listed for

3/4 WP-7843-2019 (SR. 903) directions, the learned AGP produced a copy of the order passed by the Scrutiny Committee, Nashik, second respondent to this writ petition dated 15th July, 2019 invalidating the claim of the petitioner.

A copy of this order is taken on record and marked X-1 for identification. In the light of this order, Mr. Mendadkar, seeks leave to withdraw the Writ Petition with liberty to file a fresh petition challenging the order of the Scrutiny Committee.

Leave to withdraw the Writ Petition with liberty as prayed is granted.

All contentions are kept open. The Veermata Jeejabai Technological Institute, Matunga, Mumbai need not keep the petitioner's admission to Electronic & Telecommunication

4/4 WP-7843-2019 (SR. 903) Engineering Course, alive. That seat can be alloted by the State Common Entrance Test Cell (respondents no.1 and 3 herein) to other deserving meritorious students as per the merit list.
