Learned counsel for the respondent on the basis of certified copy of the charge, makes a statement that in the present case charge was framed on 12/08/2015. This Court by an order dated 21/08/2015 had stayed the further proceedings. Learned counsel appearing for the applicant submits that in view of the fact that charge is framed, there is no question of challenging the order rejecting the discharge application. In view of this, learned counsel for the petitioner, upon instructions, seeks liberty to withdraw the application. 2) Liberty as prayed for is granted in the interest of justice, with further liberty to file appropriate proceedings in accordance with law. 3) Application stands dismissed as withdrawn.
