These applications are placed on Board for Speaking to the Minutes of the order dated 31st October, 2018, passed by this Court. Learned counsel for the applicant, on instructions, submitted that although the applicant has been directed tobe released on bail vide order dated 31st October, 2018, the trial Court has not directed the release of the applicant after executing bail bonds in accordance with the said order. It is submitted that since the order dated 31st October, 2018, passed

rpa 2/2 501-ba-1786-1779-18.doc by this Court refers to the arrest of the applicant in connection with C.R.No.I-229 of 2017, registered with Kapur Bawdi Police Station, Thane, for the offences punishable under Sections 394, 323 read with 34 of Indian Penal Code. The order is not yet implemented as the charge - sheet was filed for the offences under Sections 395 and 323 of Indian Penal Code and the applicant continues to be in custody. Such an objection was not warranted ,as the applicant was directed tobe released on bail in connection with C.R.No.I-229 of 2017 and I-619 of 2017. Be that as it may, the charge - sheet was filed in connection with C.R.No.I-229 of 2017, registered with Kapur Bawdi Police Station, Thane, for the offence punishable under Sections 395 and 323 of Indian Penal Code, trial Court is, therefore, directed to comply with order dated 31st October, 2018.
