5)APL829.14 learned Magistrate issuing process against the applicant to answer the charge for the offence punishable u/s 138 of Negotiable Instruments Act. The learned counsel Mr. Aniket Nikam, appearing on behalf of Respondent No.1 (original complainant) has submitted that the complaint has already been returned to the respondent No. 1 by the learned Magistrate for being presented before the Court having jurisdiction to try the alleged offence.

As such the present criminal application does not survive. The application stands disposed of. Since Criminal Application No. 829 of 2014 stands disposed of, Criminal Application No. 135 of 2015 does not survive and also stands disposed of accordingly. (JUDGE) md.saleem 2/2
