1] The learned counsel for the Applicant submits that an Affidavit is given by the complainant in the form of Settlement Deed, where she has categorically admitted that her grievance has been redressed as she has received the amount which was invested with the Applicant. 2] The learned counsel for the Applicant states that in respect of the other investors, he has offered them distinct amounts and the documents to that effect are annexed alongwith the Application. 3] The learned APP on instructions from the Investigating Officer states that the Investigating Officer shall issue notice under Section 41A of the Cr.P.C.

(903)ABA-2161-2022.doc Upon receipt of the notice, the Applicant shall abide by the same. The Investigating Officer shall, however, follow the procedure as prescribed under Section 41A of the Cr.P.C.
