This is an application for anticipatory bail in CR No.1032 of 2021 registered with Malwani Police Station for offences under Sections 326, 504, 506 r/w 34 of Indian Penal Code. The FIR was registered on 11th July 2021.

The case of complainant is that on 10th July 2021 the coaccused Faizan Chaudhary and the applicant approached him. There was exchange of words on account of money transaction. Faizan Chaudhary abused the complainant and assaulted him by iron rod. The applicant had allegedly caught hands of complainant. 3.

Apparently there was some money transaction between the applicant and the complainant. The said fact is spelt out from the documents which have been annexed to this application. The FIR MANISH SURESH THATTE MANISH SURESH THATTE Date: 2021.09.29 11:35:09 +0530 was lodged against applicant by co-accused vide CR No.893 of 2020 on 9th December 2020 u/s.307 of IPC.

Learned APP submitted that assault has resulted in dislocation of shoulder which was of grievous nature.

The applicant is lady It appears that complainant owed money to her. Considering the role attributed to the applicant, she need not be subjected to custodial interrogation. Hence, I pass following order :

ORDER

(i) Anticipatory Bail Application is allowed and disposed of; (ii) In the event of arrest of applicant in CR No.1032 of 2021 registered with Malvani Police Station, Mumbai, the applicant be released on bail on executing PR bond in the sum of Rs.25,000/- with one or more sureties in the like amount; (iii) The applicant shall report Investigating Officer on 4th, 5th and 6th October 2021 between 11 am and 1 pm and thereafter as and when called for till filing of charge sheet.
