The Petitioner has sought to invoke contempt jurisdiction of this Court against the Respondent for not implementing the order passed by the Division Bench of this Court on 14 January 2022. None for the Petitioner. Since it is contempt petition, we have proceeded to examine the case.

The Respondents have placed on record that they have filed a Special Leave Petition (Civil) No. 24111 of 2022, in which notice has been issued on 6 February 2023 and there is a stay of the operation and implementation of the judgment dated 14 January 2022. That Sneha Chavan

2 57-CP-596-2022=.doc being the position, there is no question of deliberate non compliance of the order passed by this Court.

In light thereof, we decline to proceed further under the contempt jurisdiction. The substantive relief to be granted to the Petitioner would depend on the outcome of the proceeding pending before the Hon'ble Supreme court.
