Heard learned Counsel for the Applicant and learned APP. 2.

Learned Counsel for the Applicant submitted that this Court (Coram:M.S.Karnik, J.) by an Order dated 23.02.2023 has granted bail to the Applicant. Condition Nos. (c) and (d) of the said Order are as under: "(c) The applicant shall report to the Investigating Officer every alternate Sunday of the month between 11.00 a.m. and 1.00 p.m., till the trial is concluded;

(d) Except to attend proceedings under section 138 of Negotiable Instruments Act 1881, filed by the Axis Bank at Kolkata, the applicant shall not leave the jurisdiction of Thane and Mumbai without the leave of the trial Court;"

Learned Counsel for the Applicant further submitted that the trial has been commenced then also Applicant has to report to the Investigating Office every alternate Sunday of every month. Applicant is a businessman, it is finding difficult for him to go every alternate Sunday to the office of the Investigating Officer. Learned Counsel further submitted that this Court has imposed condition not to leave the jurisdiction of Thane and Mumbai without leave of the trial Court, as Applicant has to go anywhere in the country for business purpose hence, requested to allow the Application.

Learned App submitted that conditions imposed by this Court are after considering the overall facts. Hence it not necessary to relax it. 5.

I have heard both the learned Counsel.

Admittedly, charge has been framed against the Applicant. As the Applicant is attending the dates of trial Court, no need to attend the office of the Investigating Officer. Applicant has submitted that his passport is with the Investigating Officer. Hence there is no chance of absconding. 7.

In view of the above, I pass following Order. (i) Application is allowed.

(ii) Condition Nos. (c) and (d) imposed on Applicant by Order dated 23.02.2023 are relaxed.
