This Petition is filed for directions to the trial Court to expedite the trial before him.

Learned counsel for the Petitioner is granted leave to add the original accused as the party Respondent. Amendment shall be carried out forthwith. The original accused is represented by learned counsel. Shri R.V. Gupta appears for the original accused. Learned counsel is permitted to file Vakilpatra for the added Respondent as early as possible.

Learned counsel for the Petitioner submitted that he is the original first informant, at whose instance the investigation was conducted and the charge-sheet was filed. He has already given notice to the original accused. 4.
Therefore, I have heard learned counsel for both the informant as well as for the accused. I have also heard learned APP.

Learned counsel for the Petitioner-first informant submitted that the Petitioner is 70 years of age. He has suffered financial loss and he had lodged this FIR. The trial is not proceeding expeditiously. Learned counsel submitted that considering the age and also the fact that he is suffering from many ailments including heart disease, the trial may be expedited.

Considering these submissions, in the interest of justice the trial can be expedited.

Learned Metropolitan Magistrate, 44th Court, Andheri, Mumbai is directed to conduct the trial in C.C. No.2300/PW/2021 expeditiously.
