1] This is an application under Section 439 of Cr. P.C. for bail in CR No. 514 of 2016 dated 13.11.2016 registered with Khed Police Station, District-Pune under Sections 302, 201, 120B r/w 34 of the Indian Penal Code.

2] It is the prosecution case that, deceased Jijabhau Varude was having illicit relations with Minabai C. Varude(Accused No.2). Applicant and accused No.3 Pramod are sons of said Smt. Minabai Varudge. That deceased had advanced a hand-loan of Rs.4.00 to Rs.5.00 lakhs to accused

2/3 No.2. Minabai. Deceased was consistently demanding the said amount from accused persons. Being enraged by the said demand by deceased Jijabhau, it is alleged that the applicant and other accused persons conspired and commited murder of deceased Jijabhau. During the course of investigation, the applicant came to be arrested on 31.11.2016. After completion of investigation, police submitted chargeshee. 3] Prima facie it appears from the the statements of son and daughter of deceased Jijabhau namely Parshuram Varude and Manisha Patankar respectively, motive is attributed to the applicant and therefore strong suspicion against him is expressed. That apart from strong suspicion, there is no other material available on record against the applicant.

In view thereof, this Court is of the view that, the applicant can be released on bail.

Hence the following Order:

(i) The applicant be released on bail in CR No. 514 of 2016 registered with Khed Police Station, District-Pune on on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.

(ii) After his release from the jail, the applicant shall attend the Khed Police Station once in month i.e. on every 1st

3/3 Monday of the said month between 11.00 a.m. to 2.00 p.m. (iii) The applicant shall also attend all the dates before the Trial Court.

(iv) Any two consecutive defaults in complying with the aforesaid conditions, shall attract the provisions of cancellation of bail.

(v) The applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(vi) Criminal Application is allowed in the aforesaid terms. (A.S. GADKARI,J.)
