Heard. Petitioner herein is challenging order of issuance of process dated 29/05/2015 passed by Judicial Magistrate First Class Vasai in S.C.C. No. 1206 of 2015. The said order is a revisable order. Learned counsel for the petitioner fairly submits that he would withdraw the petition with further liberty to file Revision Application under section 397 of Code of Criminal Procedure, 1973 before Sessions Court.

2) Liberty as prayed for is granted in the interest of justice. Learned Sessions Court shall consider the said Revision Application on its own merits without being influenced by the withdrawal of this petition. Time spent in ism
