The above Civil Application has been filed to bring the heirs of the Petitioner No.1 on record, to transpose the said heirs as the Respondents and for condonation of delay in filing the Civil Application. None appears for the Respondents, though served and though the appearance of the Advocate is appearing on the daily board. On the last occasion also no appearance was put up on behalf of the Respondents and the above Civil Application was therefore adjourned for today. For the reasons mentioned in paragraphs 4 and 6 of the Civil Application, the delay in filing the same is condoned. lgc
(904) caw-2471.16 At this stage it is not necessary to consider the impleadment of the Applicants as Respondent Nos.2, 3, 4 and 5, as the same was contingent upon whether the learned counsel for the Applicant is able to file vakalatnama of the heirs of the Petitioner No.1. The right of the Applicant to transpose them as the Respondents is kept reserved. Hence for present, the heirs are allowed to be brought on record as Petitioner Nos.1(a), 1(b), 1(c) and 1(d). Amendment to be carried out within two weeks from date. With the aforesaid directions, the above Civil Application is disposed of.
