This is an application filed by the applicant/wife seeking transfer of petition bearing Hindu Marriage Petition No.122 of 2022 pending before the learned Civil Judge Senior Division, Satara to the Family Court at Pune. The respondent/husband filed proceedings under section 9 of the Hindu Marriage Act before the learned Civil Judge Senior Division, Satara. The applicant had filed proceedings under the Domestic Violence Act bearing Criminal Miscellaneous Application No.3511 of 2021 on 24th September 2021.

The applicant/wife filed present application seeking transfer of proceedings from Satara on the ground that it is inconvenient for her to leave her children alone in Pune and attend the matter
21-mca374-2022.doc at Satara. The distance between Satara and Pune is around 110 kms.

The respondent/husband has filed reply affidavit contesting the application. It is contended that the respondent has responsibility of his bed-ridden brother and, therefore, he cannot travel to Pune. It is also stated that the applicant can attend the proceedings at Satara and the travelling expenses can be borne by the respondent. Additionally, it is submitted that the applicant can attend the proceedings through the facility of video conferencing. 4.
Having heard learned advocates for the parties and considering the reasons stated in the application, in my opinion, the ground raised in the application that the applicant has to look after her children in Pune and, therefore, it is inconvenient for her to attend the proceedings in Satara appears to be just ground for transferring the proceedings from Satara to Pune. 5.
The miscellaneous civil application is allowed in terms of prayer clause (a). No costs.
