Heard the learned Counsel appearing for the Applicant and learned APP for the State. Application is filed for setting aside the judgment and order dated 21st December 2013 passed by the Sessions Judge at Oros Sindhudurg. The Applicant has also prayed for bail during the pendency of the aforesaid appeal.

Since appeal against the said judgment and order is pending, first prayer made in the application is not maintainable. So far the bail is concerned, the Applicant had earlier filed application for bail through advocate, being Criminal Application No. 207 of 2014. After hearing both sides, Division Bench dismissed the same by the speaking order dated 4th March 2014. The Applicant has not brought patilsr 1 / 2
on record any change of circumstance. We are therefore not inclined to entertain this application and the same is dismissed. 3.
By the order dated 4th March 2014 passed in Criminal Application 207 of 2014, the Applicant was permitted to file private paper book. The learned Counsel appearing for the Applicant makes a statement that private paper book is already filed. We therefore direct Registry to add above appeal to final hearing board in the week commencing from 12th June 2017.
