In view of the order clarifying the order passed by this Court in First Appeal No.1759 of 2007 and in the special civil suit filed by the original plaintiff to the effect that those interim orders are not binding on the applicants, the applicants would be at liberty to apply for vacating the orders passed against the applicants before the State Consumer Disputes Redressal Commission, Pune District. 2.

Civil application is disposed of on aforesaid terms. No order as to costs. If any application for modification of the interim orders is

ppn 2 21.caf-2961.14.doc made by the applicants before the State Consumer Disputes Redressal Commission, the said the State Consumer Disputes Redressal Commission shall take cognizance of the orders passed by this Court. 3.

In view of the order passed by the Hon'ble Supreme Court dated 4th December 2009 in Special Leave to Appeal (Civil) No.4182 of 2008, hearing of this first appeal is expedited. The appellants have already filed a private paper book.
