Whether the Lower Appellate Court was right in reversing the finding recorded by the trial Court that the agreement dated 04.08.1995 at Exh.30 was proved? The learned counsel for the respondents waives service of notice.

Civil Application (CAS) No.1337 of 2014:

Heard the learned counsel appearing for the parties. This Court was already framed substantial question of law. The order of status quo was also passed. In view of this, the appeal is admitted there shall be stay to the judgment and decree passed by the Lower Appellate Court subject to the condition that the appellant shall not part with the possession of the suit property nor shall create any third party interest in the property.
