The matter requires to be transferred to the District Court at Khed, Ratnagiri District following the change in the limits of the pecuniary jurisdiction of this Court and that Court. The noting on the board indicates that the First Appeal St No. 26213 of 2007 which is the subject matter of Rejected Case No. 443 of 2010 has been destroyed. Mr Singh on behalf of the appellant states that on enquiry with the department, his clerk was informed that the records are not yet destroyed but are scheduled for destruction. 2nd August 2017

The Registry is directed not to proceed with the destruction of the records in First Appeal St No. 26213 of 2007 (Rejected Case No. 443 of 2010).

If it is found on re-verification that records have indeed been destroyed, the record will be reconstructed with the assistance of the learned Advocate for the appellant.

The First Appeal is directed to be restored once this verification is complete. It will then be transferred to the District Court at Khed. If the R&P or any original documents are received, these will also be transferred to that Court. 5.

All concerned to act on an authenticated copy of this order. 6.
