Heard the applicant in person and learned A.P.P. for the State. The applicant is facing trial for the offence punishable under section 138 of the Negotiable Instruments Act. He is aggrieved by the order of the Magistrate thereby recalling PW 1. It appears that PW 1 wanted to produce documents authorizing him to file the complaint. The learned Magistrate has observed in his order that this fact has not come before the court for the first time and therefore, the applicant has not been taken by surprise. No prejudice is being caused to the applicant. Present application stands dismissed.
