The prayer in this application made by the original claimants in a reference under section 18 of the Land Acquisition Act,1894 is for seeking enhancement of the claim of market value. In view of settled law, the claimant is entitled to seek enhancement of the claim made in the reference even pending the Appeal against the Award made under section 18 of the said Act.

Therefore, Civil Application is allowed in terms of prayer clauses (a)

caf235 and (b). Amendment to be carried out within a period of ten weeks from today. Deficit Court fee on the Cross Objection shall be paid within a period of ten weeks from today.
