This is a communication addressed by the original Respondent to the Hon'ble The Chief Justice, for withdrawal of the amount deposited by the original Applicant which is treated as an Application.

The Applicant in the present Civil Application is a landlord of the premises. The Competent Authority and the Additional Commissioner passed orders in his favour. The Civil Revision Application filed by the Respondent in this application was rejected on 2 July 2014. This application is taken out for withdrawal of the amount of Rs.3,68,000/- which was directed to be deposited by this Court on 22 November 2013. Copy of the Civil Application is served on the Respondent. None appears for the Respondent neither any affidavit in reply is filed. No reason is placed on record

2 17 CAC 492-14 in CRA 877-13.doc as to why after succeeding in the Revision Application, the Applicant in the present application is not entitled to withdraw the amount. Accordingly, the Civil Application is allowed in terms of prayer clause (a).
