P.C.:- 1) By a reasoned order dated 24th July, 2018 the applicant was granted interim relief and was directed to attend the Investigation Officer on stipulated dates, to join the process of investigation.
2) Heard learned counsel appearing for the applicant and the learned APP for the State. Perused the record of investigation.
3) The learned APP submitted that, the mobile phone of the applicant has been seized by the police and it has been sent for forensic analysis to the concerned laboratory and the by Radhakishan Shivlal Ladda Date: 2018.08.13 17:41:06 +0530 Radhakishan Shivlal Ladda 1/3
report of the same is awaited. She further on instructions from the first informant who is personally present in the Court submitted that the applicant has taken some objectionable photographs of the informant on his mobile phone and there is apprehension that, the applicant may circulate and/or publish the same on social media, thereby causing defamation and/or undue embarrassment to the first informant.
4) The record of investigation indicates that, till date those photographs of the informant are not published by the applicant.
In view of the apprehension expressed by the learned Addl. Public Prosecutor on behalf of the informant, the applicant is hereby put on notice that, if the applicant circulates and/or publishes the said alleged objectionable photographs of the informant, either in the society or on the social media, the pre-arrest bail granted by this Court will be cancelled at any stage till conclusion of the trial on that count alone. 5) The record further indicates that, in pursuance of the order dated 24th July, 2018, the applicant has attended the Investigating Officer and has joined the process of investigation. 2/3
6) In view thereof, the applicant can be protected by prearrest bail. Interim relief granted by order dated 24th July, 2018 is hereby confirmed. However, the applicant is directed to attend the concerned Investigating Officer, as and when called for between 11:00 a.m. to 1:00 p.m. upon receipt of a notice under Section 160 of Cr.P.C. and to join the process of investigation till filing of final report.
7) The applicant is permitted to furnish surety of his close relatives from the city of Nashik.
