The learned counsel for the Respondent has invited my attention to clause No.9 in Commercial Proposal, which contemplate reference of dispute arising out of or in connection with the claims by any party, to be resolved through arbitration and it being stated, "the place of arbitration shall be New Delhi, India". On being confronted with the aforesaid clause, the learned senior counsel for the Petitioner, seeks permission to withdraw the Petition, by reserving the liberty to invoke the jurisdiction of the competent court.
