This is an application under Section 439 of the Cr.P.C. for bail in CR No.89 of 2017 dated 14.3.2017 registered with Band Garden Police Station, Pune under Sections-4 and 5 of the Prevention of Immoral Traffic Act.

It is the case of the prosecution that, the applicant acted as an agent of the victim lady namely Rita @ Fatima Shaikh aged about 22 years on the date of the incident. That, the police have apprehended the applicant and the said victim lady at Pune Railway Station on 14.3.2017 and registered the present offence. After completion of investigation the police have submitted charge sheet.

A bare perusal of the FIR, would indicate that the victim girl was indulging in the said profession at her own will even prior to the present incident with a view to support her livelihood. 4.
In view of the above the applicant can be released on bail.

Hence, the following order.
a) The applicant be released on bail CR No.89 of 2017 dated 14.3.2017 registered with Band Garden Police Station, Pune on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.
b) After his release from the jail, the applicant shall attend the Band Garden Police Station District Pune once in month i.e. on every 1st Monday of the month between 11.00 to 2.00p.m. c) The applicant shall also attend all the dates before the Trial Court.
d) Any two consecutive defaults in complying with the aforesaid conditions, shall attract the provision of cancellation of bail, e) The applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
f) Application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
