By consent of the parties, the impugned order dated 28 April 2023 passed by the Family Court, Sangli below Exhibit 15 in Petition No.-A No.288 of 2022 is set aside. However, while setting aside, it is made clear that this Court has not considered the entitlement of respondent.

The Trial Court shall consider application below Exhibit 15 on its own merit with uninfluenced by observations made in the impugned order.

Parties shall file disclosure of assets and liabilities as contemplated by the judgment in the case of Rajnesh Versus Neha reported in (2021) 2 SCC 324 if already not filed, The Trial Court

3-wp-10520-2023.doc shall consider disclosure of assets and liabilities filed by the parties and all other relevant factors and shall decide the application afresh on its own merit.

The respondent is permitted to withdraw the amount deposited by the petitioner.
