The Company of which the petitioner is informed to have been Director was struck off from the record of the Registrar of the Company on 14th December, 2018. The aforesaid position is informed to be under challenge pursuant to provisions under Section 248 of the Companies Act, 1956, which are pending on file of National Company Law Tribunal (NCLT), Mumbai. 2.

Mr. Pradeep J. Thorat, counsel appearing for the petitioner on instructions made a motion to withdraw the present petition without prejudice to the rights of the petitioner to contest the claim pending in the proceeding as referred above before the NCLT, Mumbai.

As such, the Writ Petition stands dismissed as withdrawn with liberty as prayed for.
