CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO.1183 OF 2018 IN CRIMINAL APPEAL NO.865 OF 2003 Daulatram Chandumal Sarai ...Applicant V/s.

Union of India & Anr.

...Respondents

Mr. Ganesh K. Gole, Advocate for the Applicant. Mrs. M.T. Tidke, APP for respondent No.2/State. CORAM : A.M.BADAR, J.

DATED : 7th DECEMBER 2018.

P.C. :

1.

This is an application for early hearing moved by the respondent/accused. The appeal is challenging the acquittal of the respondent/accused. The same is filed by Union of India. 2.

The ground which is raised for seeking early hearing is old age of the applicant/acquitted accused. No expeditious hearing can be granted in such matter wherein the accused who are behind bars for more than nine years are awaiting final hearing of their appeals.

3.

The application, is therefore, rejected.
