This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 150 of 2019 registered at Bhosari Police Station, Pune for the offence punishable under Sections 302, 307, 143, 147, 148, 149 of Indian Penal Code, Sections 4 r/ w. 25 of the Arms Act, 1959 and Sections 37(1)(3), 135 of the Mumbai Police Act, 1951.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the prosecution, on 4 February 2019, the present applicant and other co-accused assaulted the deceased by koyta and sticks on account of previous enmity and committed his murder. 5.

The learned Counsel for the applicant submits that there are in all 8 accused. It is submitted that six co-accused have been granted bail. 6.

I have perused the charge-sheet. The motive for alleged crime is attributed to co-accused Ravi Manjrekar. The role attributed to the present applicant and other co-accused appears to be identical. Considering these facts, I am inclined to release the applicant on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Rushikesh Hanumant Dhotre be released on bail in Crime No. 150 of 2019 registered at Bhosari Police Station, Pune for the offence punishable under Sections 302, 307, 143, 147, 148, 149 of Indian Penal Code, Sections 4 r/w. 25 of the Arms Act, 1959 and Sections 37(1)(3), 135 of the Mumbai Police Act, 1951 on furnishing P.R.
