DATED : 12th AUGUST 2022 P.C:- Considering the nature of accusation levelled against the applicant by the complainant who is his own wife, where she allege that the applicant has wrongfully depicted and produced a receipt showing that the premises have been rented out, despite a protection order being passed by the concerned Magistrate in the D.V. proceedings, a notice u/s.41A is already issued on 21/7/2022 which is placed along with the application under Exhibit-F. The response to the said notice by the applicant is he shall remain present at some point of time after he is armed with all the necessary papers.

2/2 904 aba 2178-22.doc Learned counsel for the applicant Mr.Bansode states that he had attended to the Investigating Officer. It, however, do not appear so from the documents which are placed on record, except the letter dated 21/5/2022 where the applicant has scribed that he had attended to the Investigating Officer. If the Investigating Officer desire to have presence of the applicant, the applicant shall report to the Investigating Officer on 18th and 19th August 2022.
In case the Investigating Officer is desirous of arresting him, he shall issue 48 hours notice. Application is disposed off.
