The applicant herein is seeking transfer of the proceedings under the Provisions of Domestic Violence Act No. 61 of 2016 pending before the 5th Joint Civil Judge, Senior Division at Thane to the Family Court at Thane. The learned Counsel for the applicant submits that the proceedings are moving at snail pace and therefore, he is seeking transfer.

The learned Counsel for the respondent submits that as on today, the respondent No. 2 has stepped into the box for crossexamination, which is in progress. In view of this, it would not be necessary to transfer the Talwalkar

The learned Magistrate seized with PWDVA No. 61 of 2016 is hereby directed to conclude the recording of evidence and argument on or before 30th April, 2019. The Application is partly allowed in terms of prayer clause (c) and disposed of accordingly.
