Heard Mrs.Gajare, the learned Additional Public Prosecutor for the applicant/State. Heard Mr.Kendre, who appears for the respondents. He submits that Mr.Gole who appears for the respondents is not well and that, therefore, the matter be adjourned.

However, I find that the question is only of granting of leave to file an appeal. Hearing the respondent is not essential before deciding the question of grant of leave. In view of this, I am not inclined to adjourn the matter.

After hearing the learned APP and after going through the relevant parts of the impugned Judgment, I think it fit to grant leave as sought for.
