Pending appeal, the Oriental Insurance Co. Ltd. has deposited compensation in the Motor Accident Claim Tribunal at Gadhinglaj, Kolhapur in pursuant to the Judgment and Award passed in Motor Accident Claim Petition No. 09/2003. 2.

Respondents-Original Claimants seek leave to withdraw the amount of compensation.

Application is opposed by the learned counsel for the Appellant.

In consideration of the facts and for the reasons stated in the application, the Claimants in M.A.C.P. No. 09/2003 are permitted to withdraw 50% amount of compensation with interest accrued thereon till 31st March, 2022 subject to undertaking, to refund the amount, in the event, Appellant succeeds in First Appeal. Application is partly allowed and disposed of.
