Vide order dated 13th March 2013, the aforesaid Letters Patent Appeal ('LPA') was admitted by this Court. 2.

Today, the learned counsel for the appellant has circulated the aforesaid LPA, in view of the amicable settlement between the appellant and the respondent.

Learned counsel for the appellant has placed on record a photocopy of the Memorandum of Settlement entered into between the appellant and the respondent. The same is taken on record. Learned counsel for the appellant states that in view of para 12 of the Memorandum of Settlement, the appellant do not wish to proceed against the respondent. Para 12 of the Memorandum of Settlement reads thus;

"12. That in view of the settlement the Union the employees agree and declare that they have no claim of whatsoever nature existing or outstanding against the employer, its directors or officers in respect of any claim arising out of their employment or non-employment with the employer."

In view of the aforesaid, nothing survives for further consideration in the LPA. The LPA stands disposed of accordingly. Rule is discharged.
