On 20th August,2016, this court recorded a statement made by the learned counsel appearing for the petitioner that his client has no objection if the auditor is appointed by the Deputy Registrar Cooperative Societies, Pune by an order dated 9th April, 2015 for carrying out audit work in their premises only without removing books of account.

The matter is placed on board for admission today. 3.

Learned counsel appearing for the petitioner today states that the statement made by the petitioner was only interim arrangement and is not binding on the petitioner. He wants to argue the matter on merit on

In my view, in view of the statement made by the learned counsel for the petitioner before this court on 20th August,2016, he cannot be allowed to argue the matter on other issues. 5.

In view of the statement made by the petitioner, the Deputy Registrar, Co-operative Societies, Pune is directed to depute an auditor for carrying out auditing work in the premises of the petitioner without removing books of account.

Writ petition is disposed of in the aforesaid terms. No order as to costs.

The process of auditing shall be completed within a period of three months from today.

The petitioner shall co-operate with the officer as may be deputed by the Deputy Registrar, Co-operative Societies, Pune for the purpose of audit work. If the petitioner does not co-operate with the officer for the purpose of conducting audit, the conduct of the petitioner shall be brought to the notice of this court. [R.D. DHANUKA, J.]
