The above Civil Application has been filed for restoration of the above Writ Petition which has stood dismissed on account of the conditional order dated 20/04/2016 for non-removal of office objections. The Applicant Petitioner also seeks condonation of delay of 103 days in filing the above Civil Application.
Having regard to the fact that the above Writ Petition has been dismissed for non removal of the office objections, it would be just and appropriate to offer an opportunity to the Applicant Petitioner to remove the lgc
(11) caw-2281.16 office objections and prosecute the above Writ Petition on merits. The learned counsel appearing on behalf of the Respondents Company opposes the above Civil Application and questions the reasons mentioned in the Application.
However for the reasons stated earlier in this Order, the above Civil Application is required to be allowed and is accordingly allowed. Resultantly the above Writ Petition is restored to file. The office objections to be removed latest by 26/09/2016. If the office objections are not removed, then the above Writ Petition would once again stand dismissed for nonprosecution without further reference to the Court. The above Civil Application is accordingly disposed of.
