The birth certificate of the victim brought on record from the office of the Registrar, Gram Panchayat of UP shows that the date of birth of the victim was 12/7/1996 and therefore according to the learned counsel for the Applicant, the victim had attained age of majority on the date of the incident i.e. 22/6/2014.

The learned APP upon instructions and on the basis of the report of the Investigating Officer submits that the Investigating Agency has inquired with the Registrar's office and it is revealed that the said certificate is not issued from that office. Upon instructions from the Investigating Officer, the learned APP also submits that the Investigating Agency has received the extract from the Gram Panchayat showing that the date of birth of the victim was 12/7/2001 3.
Taking into consideration this aspect no case is made out for recall of the order dated 17/1/2017. The learned Special Court is requested to make an endeavour to conclude the recording of evidence as far as possible by 30/4/2018.
