When the matter is called out, no one else appeared on behalf of appellant. Learned Counsel for the respondent-Corporation produced a report of the Junior Engineer of respondent-Corporation on record. The same is marked 'X' for identification. In the report, it is informed to this Court that the entire building was in dilapidated condition and the so called structure of suit building has already been demolished. The learned Counsel for the Corporation drawn attention of this Court towards the photograph produced accompanied with the report of the Engineer referred above.

In view of such developments, there is no propriety to keep the present Appeal from Order alive for further process. Moreover, learned 1/2

(34) AO 1193-15.doc Counsel for the appellant is absent today. In such circumstances, the Appeal from Order stands dismissed. No order as to costs. 3.

In view of dismissal of the Appeal from Order, the Civil Application does not survive and stands disposed of.
