DATE : 8 OCTOBER 2021 P.C. :- The learned Counsel for the Petitioner restricts his prayer to the early disposal of the Appeal against the order of externment. To a query to the learned APP as to how many Appeals are pending, the learned APP placed before us the communication from the Deputy Commissioner, Pune wherein he has stated that 51 Appeals of the year 2020 and 115 Appeals of the year 2021 are pending and for some time because of the Pandemic, the hearings were suspended.

In the light of this statistics placed before us, it is not possible for us to straightaway direct early disposal of the Petitioner's Appeal as such order indirectly will affect those who are waiting without approaching the Court. There could be cases where out of turn disposal may be merited but we leave that to the discretion of the concerned Authority.
