This petition takes exception to the order dated 08 June 2022 below Exhibit 1 and the order dated 05 July 2022 below Exhibit 67 passed by Civil Judge Senior Division, Kalyan, in Special Civil Suit No. 122 of 2014 .

I have heard learned counsel for the petitioner and learned counsel for the contesting respondent.

Considering the overall facts and circumstances of the case the orders impugned are set aside, subject to the cost of Rs.10,000/- (in words Rupees Ten Thousand). The trial Court shall permit the petitioner to lead further evidence in terms of it's order dated 21 November 2014 passed below Exhibit 61. Darshan P. Patil 1/2

Petitioner has already deposited an amount of Rs.10,000/- pursuant to the order passed by this Court dated 20 October 2023 before this Court. The respondent is permitted to withdraw the said amount towards costs.
