By this civil application, the applicant seeks condonation of delay in filing the present civil application and for recall of the order dated 21st October 2016 dismissing the Writ Petition No.895 of 2016 for default in view of non-compliance of the conditional order dated 21st October 2016 passed by this Court.

Learned counsel appearing for the applicant states that amendment would be carried out within two weeks from today and undertakes to serve a copy thereof upon the respondents including the legal heirs of the deceased respondent no.2 simultaneously. Statement made by the learned counsel for the applicant is accepted as and by way of an undertaking to this Court.

It is made clear that if the amendment is not carried out
ppn 2 907.cawst-21694.18.doc within stipulated time and a copy thereof is not served upon the respondents including the legal heirs of the deceased respondent no.2, the writ petition to stand dismissed without further reference to the Court.
