The learned Counsel for the applicant upon instructions submits that during the pendency of this application, investigation is completed and charge-sheet is filed. Hence, the applicant seeks liberty to withdraw the application with further liberty to approach the Sessions court under Section 439 of the Code of Criminal Procedure, 1973.
