In pursuance of the order dated 27 October, 2021 passed by this Court, learned counsel for the respondents makes a statement that the petitioner was reinstated on 28 October, 2021. She also makes a statement that the backwages of Rs.26,72,886.11 have been deposited in this Court. Once the petitioner has been reinstated and as the respondents also have no objection for the petitioner to withdraw the amount of backwages deposited in this Court, further adjudication of this petition is not called for. 2.

At this stage, learned counsel for the petitioner states that the amount of Rs.26,72,886.11 calculated as backwages by the respondent may not be an appropriate amount as per the petitioner's calculation. If that be so, the petitioner is permitted to furnish to the respondents, details of the amounts as per his 1/2

44.WP7182_2021.doc calculation. The respondents in that event shall consider such calculation, and if it is appropriate, further steps be taken to release the payment. If the petitioner's calculation is not appropriate, no further action is required to be taken by the respondents, and to that effect, such intimation be issued to the petitioner after considering all the facts in that regard. All contentions of the parties in that regard are expressly kept open. 3.

As the amount of backwages as noted above are deposited by the respondent in the Court, the petitioner is permitted to withdraw the said amount. In this regrad, office to do the needful. Let such exercise be completed within a period of two weeks from today.

Petition is accordingly disposed of in the above terms. No costs.
