This is an application under Section 439 of Cr.P.C. for bail in C.R. No. 194/2016 dated 14.09.2016 registered with Islampur Police Station, District Sangli under Sections 307, 324, 506 of Indian Penal Code and Sections 4 and 25 of Arms Act and Section 135 of Mumbai Police Act. It is the prosecution case that due to earlier enmity, the Applicant on the date of incident i.e. on 14.09.2016 at about 6.30 p.m. assaulted the first informant with sickle on his head and face. When the driver of the first informant tried to nab the applicant, Applicant also injured him and ran away from the scene of offence. During the course of investigation, the Applicant came to be arrested on 15.09.2016. After completion of investigation, police have submitted chargesheet.

41 ba 1795-17=.doc The record clearly indicates that the version of the first informant is duly corroborated by medical certificate. The record further discloses that the driver of the first informant namely Mr. Siddharth Sawant has also suffered injuries to his fingers when he tried to nab the applicant at the scene of offence. It is to be noted here that the Applicant is involved in three other cases of similar nature and when he was on bail in the earlier crime, he has committed the present offence.

In view of the above, the Applicant does not deserve to be released on bail. Application is accordingly rejected.
