Heard learned Counsel for the parties.

This application is preferred by wife under Section 24 of CPC for transfer of divorce petition bearing no. A-1031 of 2013 filed by respondent husband in the family Court at Bandra, Mumbai to Additional District Judge, Amalner, Dist. Jalgaon. During the Course of the argument, the learned Counsel for the applicant filed application dated 04.09.2015 stating that applicant has no objection to transfer the divorce Petition no. A-1031 of 2013 to the District Court at Jalgaon along with Criminal Misc. Application No. 114 of 2013 filed by the applicant wife under Protection of Women from the Domestic Violence Act, 2005 in the Court of J.M.F.C. Chopada, District Jalgaon.

43 mca 159-14=.doc husband also makes a statement that if both the matters are heard in District Court at Jalgaon, they also have no objection.

Hence, by consent of both the parties, the following order is passed:

ORDER

a) The Family Court at Bandra, Mumbai is directed to transfer the Divorce Petition No. A-1031 of 2013 filed by the respondent husband to the District Court at Jalgaon with pending applications, if any, immediately.

b) The office of District Court at Jalgaon is directed to call papers and proceeding of Criminal Misc. Application No. 114 of 2013 pending in the Court of J.M.F.C. Chopada filed by the Manisha Ulhas Baviskar under Protection of Women from the Domestic Violence Act,2005 for hearing and final disposal at Jalgaon and to assign the matter to appropriate Court.

c) The parties are directed to appear before the District Court at Jalgaon on 05.10.2015 for fixing date of hearing in both the matters.

d) Parties to act on authenticated copy of this order.

e) Misc. Civil Application stands disposed of accordingly.
