This is an application for modification of condition imposed by order dated 31.3.2015 in Bail Application No.2657 of 2015.

This Court while enlarging the applicant on bail, by order dated 31.3.2015 imposed a condition that the applicant shall not enter the jurisdiction of the Vikroli Police Station where the family members of deceased reside. The learned Counsel for the applicant submits that as a matter of fact as of today no family members of the deceased are residing within the jurisdiction of Vikroli Police Station. She further submits that the entire case is based on circumstantial evidence. She submits that the applicant being a student, intends to submit his project

Dond 2/2 appp.681-2015.sxw report in the Sandesh Vidyalaya, Vikroli (East) and for that purpose the applicant may be allowed to enter the jurisdiction of Vikroli Police Station. The learned APP on instructions submits that the contention of the learned Counsel for the applicant is correct that as of today the relatives of the family members of the deceased left Vikroli. She however submits that other witnesses are still residing within the jurisdiction of Vikroli Police Station . In view of the above, the order dated 31.3.2015 is modified to the extent that the applicant is allowed to enter the jurisdiction of Vikroli Police Station on 5th December 2015 for the purpose of submission of project report to the above college. The applicant shall enter the jurisdiction of Vikroli Police Station on 5th December 2015 after 9.00 a.m. and shall leave the same before 6.00 p.m. on the same day.

The application is allowed in the aforesaid terms. All the concerned to act on an authenticated copy of this order.
