DATE : OCTOBER 7, 2019 P.C. :- By the order impugned dated March 22, 2017, the petitioners are challenging the fnding of fact recorded in Chamber Summons No.1561/2015 in Suit No.8620/2002, seeking condonation of delay in bringing the legal heirs of the same defendant No.1 on record.

The trial Court has considered the date of death of defendant No.1 and the date of taking out the chamber summons, which is found to be the basis for recording the fnding.

The fnding appears to be just and proper, which does not warrant any interference. The petition is dismissed. (NITIN W. SAMBRE, J.)
