Mr. Nikhil Mehta, learned counsel for the appellant submits that the matter has been settled before the Executing Court. He has placed on record copy of the purshis filed before the Executing Court. In view of the settlement between the parties, he seeks leave to withdraw the appeal.

The learned counsel for the appellant further submits that the appellant / insurance company has paid the entire amount as agreed 1/2

P.H. Jayani 505 CAF4002.18.doc by the parties. He submits that the insurance company may be permitted to withdraw statutory amount of Rs.25,000/- which has been transferred to MACT, Mumbai.

In view of the above, leave is granted. First Appeal stands dismissed as withdrawn. Civil applications stands disposed of in view of dismissal of the appeal. The appellant is permitted to withdraw statutory amount of Rs.25,000/- which was transferred to MACT, Mumbai.
